THIS DOCUMENT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS THE CONDITIONS, LIMITATIONS, AND EXCLUSIONS APPLICABLE TO YOUR USE OF ASTA HOUSE'S DIGITAL SERVICES. PLEASE READ IT CAREFULLY.

BY ACCESSING, BROWSING, OR USING THE WEBSITE, DIGITAL PLATFORMS, SERVICES, OR ANY CONTENT PROVIDED BY ASTA HOUSE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS OF USE (“TERMS”), AS WELL AS OUR PRIVACY NOTICE AND ANY ADDITIONAL POLICIES POSTED ON THE WEBSITE.

If you do not agree to these Terms, you must refrain from accessing or using ASTA House's digital platforms.

These Terms constitute a legal agreement between you (“User”, “you”) and ASTA House (“ASTA House”, “we”, “our”).

1. Definitions

For the purposes of these Terms:

“Digital Platforms” means the website https://www.astahousemx.com/, mobile applications, social media, marketplaces, auction platforms, and any digital service operated by ASTA House.
“Content” includes text, images, photographs, videos, designs, graphics, catalogs, trademarks, software, and any other material available on the Digital Platforms.
“Services” includes auctions, private sales, consulting, consignments, exhibitions, editorial content, and any other service offered by ASTA House.

2. Use of digital platform

Access to and use of the Digital Platforms is permitted solely for personal, informational, and legitimate purposes related to the services offered by ASTA House.

You represent and warrant that:

(a) you have the legal capacity to enter into binding contracts;

(b) you will use the Digital Platforms in accordance with these Terms and applicable law;

ASTA House may modify, suspend, or discontinue any aspect of the Digital Platforms at any time without prior notice.

3. Intellectual property

All intellectual property rights related to the Digital Platforms and their Content are the exclusive property of ASTA House or their respective owners.

Use of the Digital Platforms does not grant the User any ownership rights to:

trademarks; logos; trade names; images; catalogs; editorial content; software; designs; photographs; videos; or any other protected material.

The reproduction, distribution, modification, publication, transmission, commercialization, or exploitation of the Content without the prior written authorization of ASTA House is strictly prohibited.

4. Limited License

ASTA House grants the User a limited, revocable, non-exclusive, and non-transferable license to access and use the Digital Platforms solely for personal, non-commercial purposes.

This license does not permit: reselling services; copying databases; scraping information; reproducing catalogs or images; using content for artificial intelligence training; using unauthorized automation; or reverse engineering the software.

5. Prohibited Conducts

The User agrees not to:

(a) use the Digital Platforms for illegal or fraudulent activities;

(b) interfere with the operation or security of the Digital Platforms;

(d) transmit viruses, malware, or other harmful code;

(e) collect personal information from other users;

(f) use bots, crawlers, scrapers, or other automated systems without authorization;

(g) infringe intellectual property rights;

(h) use the Content for commercial purposes without authorization;

(i) manipulate prices, bidding processes, or sales mechanisms;

(j) engage in money laundering, collusion, or market manipulation.

ASTA House may suspend or terminate the access of any User who violates these Terms.

6. Account Registration

Some Services may require account creation.

The User is responsible for:
maintaining the confidentiality of their credentials;
all activities conducted from their account;
immediately notifying ASTA House of any unauthorized access.

ASTA House may reject registration requests or terminate accounts at its discretion.

7. User Information and Privacy

The processing of personal data will be governed by ASTA House's Privacy Notice and applicable data protection laws.

The User acknowledges that any information submitted through the Digital Platforms may be used by ASTA House to operate the Services, process requests, and comply with legal obligations.

8. Auctions and sales

Auctions, private sales, consignments, and other business transactions conducted by ASTA House may be subject to additional terms and conditions.

Participation in an auction constitutes a binding offer.

ASTA House reserves the right to: reject bids; withdraw lots; cancel sales; request additional documentation; verify identity and source of funds; and limit participation in events or transactions.

9. Materials submitted

Any suggestion, comment, idea, proposal, or material submitted to ASTA House may be used by ASTA House without obligation of compensation, confidentiality, or acknowledgment, except as provided by applicable law.

The User declares that they possess the necessary rights to any submitted material.

10. Third-Party Links

Digital platforms may contain links to third-party websites or services.

ASTA House does not control or assume any responsibility for the content, security, availability, or policies of third parties.

Access to third-party sites is at the user's sole risk.

11. Exclusion of Guarantees

DIGITAL PLATFORMS AND ALL SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

ASTA HOUSE DOES NOT GUARANTEE:

uninterrupted availability;
absence of errors;
absolute accuracy;
technological compatibility;
absence of viruses;
specific results.

All information related to works, design, objects, artists, or cultural property is provided for informational purposes only.

12. Limitation of Liability

To the fullest extent permitted by law, ASTA House will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the Digital Platforms or Services.

ASTA House's total aggregate liability to the User will not exceed the amount actually paid by the User to ASTA House in connection with the specific service that gave rise to the claim.

13. Compensation

The User agrees to indemnify and hold harmless ASTA House, its directors, affiliates, employees, and collaborators from and against any and all claims, losses, damages, liabilities, or expenses arising from:

breach of these Terms;
misuse of the Digital Platforms;
legal or regulatory violations;
intellectual property infringements.

14. Termination

ASTA House may suspend or terminate a User's access to the Digital Platforms at any time, with or without prior notice.

The provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution will survive termination.

15. Dispute Resolution

These Terms shall be governed by the laws of the United Mexican States.

Any dispute arising from these Terms shall be submitted to the competent courts of Mexico City, and the parties expressly waive any other jurisdiction that may apply.

ASTA House may opt for alternative dispute resolution mechanisms, including mediation or arbitration.

16. Modifications

ASTA House may modify these Terms at any time by posting them on the Digital Platforms.

Continued use of the Digital Platforms will constitute acceptance of the modifications.
